I.B.I. Volcano Investments LLC（Ziv Sapir、プリンシパル）と West 4 Capital LP（Yaron Eilot、CEO。ケイマン ELP）がニューヨークで [Crew](/ja/companies/crew/）（旧 Versity Invest）を訴えた。Index 652237/2025。借り手は Apex South Creek IB, LLC。担保付約束手形 3 通、日付 2022 年 11 月 18 日：

  • Comrit Investments 1, LP · $11,000,000（2023 年 7 月 3 日 Volcano へ譲渡）

クーポン 12%。不履行利率 14%（クーポン + 2%）。遅延損害金 5%、10 日後。組成 2%（Volcano 手形。決済時 1.5% + 21 日後 0.5%）。3 か月延長ごとに残元本の 1%。手形は Apex South Creek, DST における IB の受益持分の質であり、Orlando 土地の抵当ではない。Volcano 手形は、決済時 IB が DST 持分の 100% を持ったと述べる。同日の Trust Agreement も同じ。第一抵当は Walker & Dunlop、約 $45,994,000、同じく 2022 年 11 月 18 日。売れた持分の償還代金の 90% は 5 営業日以内に貸手へ、元本に充当。当期利息は別。2024 年 4 月の修正のあと、その分割は 77% Volcano / 13% West 4 になった。

Crew が唯一の指名保証人である。これらの添付は LLC の支払保証であり、Wettengel や Muro の個人保証ではない。当初満期 2023 年 5 月 18 日。3 か月延長二つ。次いで第一次修正 2024 年 4 月 5 日（West 4）と 2024 年 4 月 10 日（Volcano / Comrit）が満期を 2024 年 5 月 18 日へ。未使用の 2024 年 8 月 18 日までの選択権あり。Wettengel が IB のために署名。Muro が Versity Invest の CRO として署名。

Sapir の 2025 年 4 月 7 日宣誓は、借り手が 2023 年 11 月以降利息を払っていないと言う。BCLP 債務不履行通知 2024 年 11 月 11 日（宛先 Frank Muhlon）は $44,611,907 を求め、IB が取得手数料 $4 million を自らに分配したと主張した。貸手の請求であり、認定ではない。

2025 年 7 月 15 日 Justice Melissa A. Crane は反対のない CPLR 3213 申立てを欠席により一部認容した（NYSCEF Doc 26）。Crew は出頭も反対もしなかった。2025 年 3 月 31 日時点の残元本：Volcano $23,690,525、Comrit $10,423,831、West 4 $3,370,568。Crane は Volcano へ $42,953,402（Volcano + 譲渡された Comrit）、West 4 へ $4,242,913 の判決を指示。2025 年 4 月 1 日から命令日まで 14%、その後は法定利率。弁護士費用は偏見なしに却下。事件は終了と標示。

    IBI Volcano and West 4 Capital move for summary judgment in lieu of complaint against Crew on the Apex IB guaranties (NY Index 652237/2025). Motion seeks $47,196,315 as of 31 Mar 2025.

    Crane (NY Index 652237/2025) grants the unopposed CPLR 3213 motion in part on default. Crew neither appeared nor opposed. Judgment directed: $42,953,402 to IBI Volcano (including assigned Comrit) and $4,242,913 to West 4, plus 14% from 1 Apr 2025. Attorneys’ fees denied without prejudice.
